11. Communications & Consent to Contact (incl. text)

By enrolling, you agree to receive operational messages (class reminders, schedule changes, show info, billing) by app notification, email, and text/SMS, including from our assistant, Disha. Message & data rates may apply; reply STOP to opt out of texts, HELP for help. You can opt out of marketing anytime; essential account messages continue while you're a member. Any required notice, including cancellation, withdrawal, a hold, or that a Dancer will not perform, must be in writing through the app or to support@rrbdancecompany.com. Verbal communication, including to an instructor, is not valid notice.

12. Photo & Video Release (required)

Because classes are taught in a group setting, RRB cannot selectively exclude individuals from photos or recordings. As a condition of enrollment, you grant RRB permission to photograph and record classes, rehearsals, and performances and to use that media in any and all marketing, including social media. This release is required and applies to you and each Dancer on your account.

13. Conduct, Safety & Facilities

You agree to follow all safety instructions and posted/verbal directions, avoid restricted or "employees-only" areas, and bring no weapons (or anything reasonably perceived as one) onto the premises, including parking lots, regardless of any permit. You take full responsibility for your and your Dancer's behavior and for any damage you cause to facilities used by RRB. RRB may, in good faith, remove a Dancer whose conduct endangers or repeatedly disrupts others.

15. Health & Emergency Care

You confirm each Dancer is healthy enough to participate and that your family's health insurance is current. You will tell us of any condition affecting participation. In a medical emergency where you cannot be reached, you authorize RRB to seek emergency medical care for the Dancer at your expense.

18. Billing Authorization & Chargebacks

By enrolling you authorize RRB to charge your payment method on file for tuition and agreed fees on a recurring basis until you cancel per this Agreement. All charges are authorized and all sales are final. If you believe a charge is incorrect, you agree to contact RRB first (support@rrbdancecompany.com) to resolve it. You agree not to initiate a chargeback or bank dispute for a valid charge; doing so is a breach of this Agreement. A $45 fee applies to each chargeback, and for any invalid or fraudulent chargeback you are responsible for the disputed amount plus our costs to contest it (including processor and reasonable attorney fees); RRB may suspend enrollment until the balance is resolved.

19. Assumption of Risk, Waiver & Release of Liability

I AM AWARE AND UNDERSTAND THAT THE ACTIVITY IS A POTENTIALLY DANGEROUS ACTIVITY AND INVOLVES THE RISK OF PERSONAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, TEMPORARY OR PERMANENT DISABILITY, DEATH, PROPERTY DAMAGE, AND/OR FINANCIAL LOSS. I ACKNOWLEDGE THAT ANY INJURIES MAY RESULT FROM OR BE COMPOUNDED BY THE ACTIONS, OMISSIONS, OR NEGLIGENCE OF RRB DANCE COMPANY. NOTWITHSTANDING THE RISK, I AM KNOWINGLY AND VOLUNTARILY PARTICIPATING WITH AN EXPRESS UNDERSTANDING OF THE DANGER INVOLVED AND AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF RRB DANCE COMPANY OR ANY RELEASEE OR OTHERWISE. I hereby expressly waive and release any and all claims, now known or hereafter known, against RRB Dance Company and its owners, officers, directors, employees, instructors, agents, affiliates, successors, and assigns (collectively, "Releasees"), on account of injury, illness, disability, death, or property damage arising out of or attributable to my participation or the participation of any Dancer on my account, whether arising out of the ordinary negligence of RRB or any Releasees or otherwise. This waiver and release does not extend to claims for gross negligence, willful misconduct, or any other liabilities that California law does not permit to be released by agreement.

20. Indemnification & Attorney Fees

I shall defend, indemnify, and hold harmless RRB and all Releasees against any and all losses, damages, liabilities, claims, judgments, settlements, penalties, costs, or expenses (including reasonable attorney fees) arising out of any third-party claim related to my participation, including any claim related to my own negligence or the ordinary negligence of RRB. In any dispute arising out of this Agreement, the prevailing party is entitled to recover its reasonable attorney fees and costs.

21. E-Signature, Governing Law, Assignment & Entire Agreement

You consent to sign electronically; your electronic signature is binding. This Agreement is governed by the laws of the State of California, with exclusive venue in the state and federal courts located in San Bernardino County, California. RRB may assign this Agreement (e.g., in a sale or reorganization of the business). This Agreement is the entire agreement on this subject and supersedes all prior understandings; if any provision is invalid in any jurisdiction, the rest remains in effect; it binds and benefits the parties' successors and assigns. We may update these terms with written email notice; continued enrollment means acceptance.

22. Acknowledgment & Signature

I am the account holder, 18 or older, have read and agree to this Agreement (including Auto-Renewal in §6, the Chargeback terms in §18, the Release in §19, and the Photo/Video Release in §12), and I am signing on behalf of myself, and on behalf of and as parent/legal guardian for each Dancer (adult or minor) I add to my account.
